Avoid the AED 10,000 Corporate Tax Penalty. Here’s How:
The UAE Federal Tax Authority has just issued a key clarification that could save your business AED 10,000, if you act within a narrow window.
If you missed the Corporate Tax registration deadline, you now have a formal route to avoid the late registration penalty. This isn’t a grace period. It’s a one-time opportunity, and it hinges entirely on when you file your first tax return.
Who Qualifies and What You Need to Do
According to Public Clarification CTP006 (April 2025), any taxable person may benefit from the waiver if:
- You submit your first Corporate Tax Return within 7 months of the end of your first tax period
- This applies to:
- Taxable entities (including Free Zone Persons and tax groups)
- Entities applying for exemptions under Article 4(1)(e–i) of the Corporate Tax Law
- Qualifying public benefit entities, pension and investment funds
🔔 You are not required to pay the tax within 7 months.
The tax payment deadline remains 9 months from the end of the tax period.
Example Timeline: First Tax Period = Jan–Dec 2024
| Action | Deadline |
| Submit Tax Return | By 31 July 2025 |
| Pay Corporate Tax | By 30 September 2025 |
| Late Registration Penalty | Waived ✅ |
By submitting the return early, you keep your record clean and preserve working capital.
Already Paid the AED 10,000? You’re Still Covered
If the penalty has already been paid, the FTA will:
- Automatically credit the amount to your EmaraTax account
- You can either use the credit for future tax payments or
- Request a refund directly via the EmaraTax portal
Why This Matters for Business Owners and Groups
This is not just technical guidance, it’s a clear strategic move by the FTA to encourage early alignment with the Corporate Tax regime. It’s also a cash flow shield for entities still navigating the first-time filing process.
For our clients, whether you operate as a Free Zone business, a holding group, or are applying for exemption, this waiver provides a short but valuable compliance window.
What’s at stake if you delay:
- AED 10,000 lost in penalties
- Potential administrative flag on your company
- Limited flexibility for future restructuring
