TRC Eligibility in the UAE: Documentation and Common Pitfalls

Securing a UAE Tax Residency Certificate (TRC) can unlock a wide range of international tax benefits, but only if eligibility requirements are met and supporting documents are correctly prepared. Both individuals and companies must follow formal procedures when applying through the Federal Tax Authority (FTA).

This post outlines the eligibility criteria and common pitfalls that can delay or derail TRC applications.

 

Eligibility Criteria for Individuals (Natural Persons)

To apply for a TRC as an individual, the applicant must:

  • Hold a valid UAE residence visa
  • Have resided in the UAE for at least 183 days in the past 12 months
Required Documents:
  • Copy of passport, residence visa, and Emirates ID
  • Certified lease agreement (Ejari or municipal tenancy contract)
  • 6-month UAE bank statement showing personal income and expenses
  • Income proof (employment contract or trade license)
  • GDRFA or ICA residency report
  • Foreign tax form (if required by destination country)

 

Eligibility Criteria for Companies (Legal Persons)

To apply for a TRC as a company, the entity must:

  • Be registered in mainland UAE or a free zone
  • Have been operational for at least one full year
Required Documents:
  • Valid trade license
  • Memorandum of Association (MOA)
  • Certified tenancy contract (Ejari or equivalent)
  • Shareholder structure documentation
  • Audited financial statements for the relevant year
  • 6-month UAE bank statement (company account)
  • IDs and visas of directors/shareholders
  • Foreign tax form (if applicable)

Note: Offshore companies without physical presence in the UAE or economic substance are not eligible for TRCs.

 

Common Pitfalls That May Lead to Delays or Rejections
  • Insufficient residency proof: Applicants must demonstrate a physical and economic link to the UAE.
  • Missing or outdated documentation: Submissions must include current tenancy contracts, valid IDs, and recent financials.
  • Non-UAE activity: Business or personal income not linked to the UAE may undermine the application.
  • Inconsistent information: Any mismatch between declared data and official records may lead to rejection.
