For several years, RAK ICC companies and foundations could hold Dubai real estate, but only under a discretionary, case-by-case process. That has now changed.
The Dubai Land Department (DLD) has confirmed a systematic framework that allows RAK ICC International Business Companies (IBCs) and Foundations to register freehold property titles in Dubai.
Why this matters
- Predictability. What was once uncertain is now a ratified process, giving investors and family offices clarity.
- Succession planning. RAK ICC’s July 2025 foundation amendments introduced stronger governance tools, making foundations an ideal vehicle to hold real estate for future generations.
- Efficiency in transfers. When a property is transferred to a foundation or company owned by the same UBO, the DLD fee is only 0.125%, compared to the usual 4%.
What to consider
- Only designated freehold areas remain eligible.
- Transfers still require full UBO documentation and compliance.
- The structure chosen, IBC or Foundation, depends on whether the priority is flexibility (IBC) or legacy protection (Foundation).
