What Is Tax Residency?

Tax residency is not about citizenship, it’s about where your financial life is officially based for tax purposes. In the UAE, obtaining tax residency can grant you:

  • A Tax Residency Certificate (TRC) issued by the Federal Tax Authority
  • Access to 120+ double tax treaties with countries around the world
  • Legal recognition that your personal and business interests are rooted in a no-income-tax jurisdiction

 

What Are the UAE Tax Residency Criteria?

As of March 1, 2023, under Cabinet Decision No. 85 of 2022, an individual is considered a UAE tax resident if they meet any one of the following conditions:

  1. 183-Day Rule

You are physically present in the UAE for 183 days or more within any consecutive 12-month period.

  1. 90-Day Rule (with additional conditions)

You are physically present in the UAE for at least 90 days within any consecutive 12-month period and:

  • You hold a valid UAE residence permit or are a UAE or GCC national, and
  • You either have a permanent place of residence in the UAE or carry out employment or business here

      ⚠️ Note: The 90-day rule is not a standalone pathway to residency. It applies only if both additional conditions are met.

  1. Primary Residence & Centre of Interests

If the UAE is your primary place of residence and the centre of your personal and financial interests, you may qualify, regardless of the number of days spent.

 

What Does This Mean in Practice?
  • You cannot qualify under the 90-day rule unless you meet both the visa/GCC national and residence or work requirements.
  • The 183-day rule is straightforward and doesn’t require additional links to the UAE.
  • Having your family, home, or business operations in the UAE can support your position under the “centre of life” test.

 

What Documents Are Typically Required?

To apply for a UAE Tax Residency Certificate (TRC), you’ll need:

  • UAE entry and exit records
  • Proof of address (rental agreement or title deed)
  • Bank statements or utility bills
  • A valid UAE residence visa (if applicable)
  • A statement confirming non-residency in any other jurisdiction

 

What About Businesses?

A legal entity is considered a UAE tax resident if:

  • It is incorporated or registered in the UAE, or
  • It is effectively managed and controlled from the UAE

Foreign branches do not automatically qualify unless they meet specific criteria under UAE tax law.

  • Spend 90+ or 183+ days per year in the UAE
